Terms of Sale

Photography Session and Product Terms

Last updated: 1 October 2026

These terms explain what you can expect when booking Lucy Rose Studios and what is needed in return. Please read them before paying your booking deposit.

Nothing in these terms affects your statutory consumer rights.

1. About Lucy Rose Studios

Lucy Rose Studios is owned and operated by Lucy Okey, trading as Lucy Rose Studios.

You can contact me at:

Email: lucy@lucyrosestudios.com

In these terms, “I”, “me” and “my” refer to Lucy Rose Studios. “You” and “your” refer to the person making the booking.

The person making the booking must be at least 18 years old and have authority to agree to these terms on behalf of everyone participating in the session.

2. What these terms cover

These terms cover photography sessions, digital photographs and physical products purchased from Lucy Rose Studios.

Your booking confirmation, pricing guide and any written details agreed specifically for your session also form part of our contract.

If anything in your individual booking confirmation differs from these general terms, the written information provided specifically for your booking will take priority.

3. Forming the contract

Website pages, social-media posts and pricing guides provide information about my services but do not, by themselves, create a contract.

After you enquire, I will confirm availability and send you the relevant booking information.

Your photography session contract becomes binding when:

- You accept the booking terms.
- I receive the required booking deposit.
- I send written confirmation of your session.

A separate contract for digital photographs or physical products is formed when you confirm your selection, accept the relevant price and I accept payment.

Please check your confirmation carefully and tell me promptly if anything is incorrect.

 4. The booking deposit

A booking deposit is required to reserve your session date.

Unless your booking confirmation expressly says otherwise, the deposit covers reserving the date and the work involved in preparing for and photographing your session. It does not include digital photographs or physical products and is not deducted from the price of a later image package.

Your date is not secured until the deposit has been received and I have sent confirmation.

Different deposits may apply to mini sessions, special events or promotional sessions. Any different amount and payment arrangement will be explained before you book.

 5. Image packages and additional products

Following a standard session, you will receive a watermarked proof gallery from which to choose your photographs and package or you can come to a viewing session with me and look through an un-watermarked gallery.

The prices and contents of individual packages will be confirmed in the pricing guide supplied for your booking. You are not required to purchase more than any minimum commitment clearly disclosed before you book.

Albums, wall art, prints and other physical products are optional unless your chosen package expressly includes them.

Prices may change for future bookings. A price change will not alter an order I have already accepted.

All prices include applicable taxes unless clearly stated otherwise. Delivery charges will be disclosed before you place a physical-product order.

 6. Your 14-day cancellation right

If you book online, by email, by telephone or anywhere away from my business premises, you will normally have the legal right to cancel the photography-service contract within 14 days without giving a reason.

The cancellation period begins the day after the contract is formed.

To cancel, email lucy@lucyrosestudios.com with a clear statement that you wish to cancel. You may use the cancellation form at the end of these terms, but you do not have to.

If you cancel within the applicable 14-day period before I begin providing the service, I will refund payments covered by the cancellation within 14 days of receiving your notice.

If you expressly ask me to begin providing the service during the cancellation period, you may be required to pay a reasonable amount for work completed before you cancel.

If the photography service is fully performed during the cancellation period, your cancellation right will only end early where you expressly requested early performance and acknowledged that the right would be lost once the service had been fully performed.

 7. Cancelling after the cooling-off period

If you cancel after the statutory cancellation period, please tell me as soon as reasonably possible.

Because I reserve your date and may turn away other work, I may retain some or all of the booking deposit to cover reasonable losses directly caused by the cancellation. This may include work already completed and the value of a date I cannot reasonably refill.

I will take reasonable steps to reduce my loss. If I refill the cancelled date with an equivalent booking, I will consider whether an appropriate refund or credit is due after deducting reasonable work and costs already incurred.

I will not automatically charge you for losses I have avoided.

Any additional amount paid for work or products that have not been supplied will be refunded, subject to any lawful deduction for work already completed at your request.

8. Moving your session

Standard bookings include one complimentary date change, subject to availability.

Please give as much notice as reasonably possible. Your replacement date must take place within 2 months of the original booking unless we agree otherwise in writing.

A further request to move the session may be treated as a cancellation and new booking. I will explain any reasonable additional cost before confirming the change.

If you need to rearrange because of an emergency, significant illness or another exceptional circumstance, please contact me. I will consider the circumstances fairly rather than applying an automatic penalty.

 9. Newborn-session dates

Newborn-session dates are usually based on the expected arrival of your baby and may need to move.

Please contact me after your baby is born, or sooner if you know the circumstances have changed. Moving a provisional newborn date because your baby arrived early or late does not use your complimentary date change.

I will make reasonable efforts to offer a suitable replacement date, subject to my availability and the needs of your family.

10. Illness and safety

Please do not attend the studio where you or a participant has a contagious illness that could place another client, a newborn or my family at risk.

Contact me as soon as possible, and we will discuss rearranging the session.

I may pause or end a session if I reasonably believe that continuing would be unsafe, unlawful or likely to cause harm. This may include unsafe behaviour, abusive conduct or a refusal to follow reasonable studio-safety instructions.

A parent or responsible adult must supervise children throughout the session. I remain responsible for performing my photography work with reasonable care and skill, but parents and guardians retain ordinary responsibility for their children.

Please tell me before the session about any access requirements or relevant circumstances that I reasonably need to know to provide the service safely.

11. Outdoor sessions and weather

Outdoor sessions depend on suitable weather, light and safe access to the location.

Cloud, breeze or light seasonal weather will not necessarily require a change. If I believe conditions are unsafe or unsuitable for the agreed session, I may suggest a different time, date or location.

Where I decide that postponement is necessary because of the weather, your deposit will transfer to the rearranged session and the change will not use your complimentary client-requested date change.

 12. Late arrival and failure to attend

Please arrive at the agreed time.

If you are delayed, contact me as soon as possible. I will try to accommodate a late arrival, but a session may need to be shortened if extending it would affect another commitment or suitable light.

If you do not attend and have not contacted me, the booking may be treated as cancelled. Any amount retained will be limited to my reasonable loss, including preparation already completed and the reserved time I could not refill.

13. What happens during the session

Every baby, child and family is different. I will guide you throughout, but I cannot guarantee that a baby will sleep, a child will respond in a particular way or that a specific pose or expression will be achieved.

Feeding, comforting and breaks are welcome during full sessions. The absence of a particular pose or expression does not, by itself, mean the service has not been provided with reasonable care and skill.

You are responsible for making sure that everyone whose attendance is important to you is present at the agreed time.

Any restrictions on participant numbers, pets, locations or session duration will be explained in the booking information for your particular session.

 14. Creative style and editing

By booking, you confirm that you have reviewed my portfolio and understand my natural-light photographic style.

I retain creative control over lighting, composition, posing, image selection and editing while taking account of any preferences discussed before the session.

Colours and brightness can vary between screens and printed products. Minor variations do not necessarily mean that an image or product is defective.

RAW or unedited files are working materials and are not supplied.

Requests for substantial additional retouching, body alteration, object removal or edits outside my normal style may not be accepted. If I can accommodate a request, I will explain any additional charge before beginning the work.

 15. Proof gallery and image selection

I aim to provide your watermarked proof gallery within two weeks of the session.

This is an estimated turnaround rather than a guarantee. If an unexpected delay occurs, I will keep you informed.

Proof images are provided solely to help you choose a package. They are not final files and must not be copied, downloaded, screenshot, edited, published or otherwise used.

Your gallery email will explain the selection deadline and how long the gallery will remain available. If you need more time, please contact me before it expires.

Final editing and delivery will begin after you have submitted your selection and paid the relevant package price.

The expected delivery time for final digital files will be stated when your selection is confirmed.

16. Digital photographs

Final digital photographs will normally be supplied through a private online gallery in the file type and resolution described in your package.

You are responsible for downloading the files before the gallery expires and making secure backups.

I retain files as part of my professional archive, but I cannot guarantee that replacement copies will remain available indefinitely. Long-term archival storage is not a substitute for your own backups.

If a supplied file is corrupt, incomplete or does not materially match the agreed package, please contact me so I can investigate and provide an appropriate remedy.

16.1 Image editing

The Client understands that photographs may be processed using professional editing and retouching software by the Photographer, including secure third-party or cloud-based services used as part of the Photographer’s normal workflow. The Photographer keeps everything offline unless more extensive re-touching is required - should you not wish the Photographer to use this and keep everything offline, let her know. Editing will be completed in the style shown in the Photographer’s portfolio.

 17. Cancellation rights for digital files

Digital photographs supplied by download are digital content.

If digital files are to be supplied within a statutory 14-day cancellation period, I will ask you to:

- Expressly request that supply begins during that period.
- Acknowledge that you will lose the right to cancel once the download or supply begins.
- Confirm that agreement as part of the order process.

A loss of the change-of-mind cancellation right does not affect your rights where digital content is faulty, materially not as described or otherwise fails to meet applicable consumer law.

Personal-use licence and copyright

Copyright in all photographs remains with Lucy Rose Studios unless I expressly agree to a written copyright assignment.

When you purchase digital photographs, I grant you a continuing, non-exclusive licence for private and domestic use. You may:

- Download and store the files.
- Make personal backup copies.
- Print them for yourself or as gifts.
- Share them privately with family and friends.
- Post them on your personal social-media accounts.

You must not sell the photographs, license them to another person, use them to promote a business or submit them for commercial publication without written permission.

Please do not apply filters, materially alter the editing, remove watermarks or present a substantially altered version as my finished work. Ordinary cropping carried out automatically by a social-media platform is permitted.

This personal-use licence does not give Lucy Rose Studios permission to publish your photographs. Any use by me for my website, social media, advertising, competitions or portfolio is governed by a separate and optional image release.

19. Physical-product orders

Please check image choices, product sizes, cover materials, spelling and personalisation carefully before approving an order.

Personalised products are manufactured to your specification. Once production has begun, changes or cancellation may not be possible.

Where a requested change can be accommodated, I will tell you about any reasonable additional production or administration cost before proceeding. I will not impose an automatic charge unrelated to the work or cost caused by the change.

Personalised or made-to-order products are normally excluded from the statutory change-of-mind cancellation right. This does not affect your rights where a product is faulty, damaged, not as described or does not meet another applicable legal standard.

20. Delivery and collection

The estimated production time for physical products will be confirmed when you order.

Products may be collected by appointment or delivered where that option has been agreed. Any delivery charge will be disclosed before the order is confirmed.

If delivery is delayed by a manufacturer, courier or another circumstance outside my reasonable control, I will keep you informed and provide a revised estimate.

If I cannot supply the agreed product, I will offer an appropriate alternative where available. You do not have to accept a materially different substitute. If no suitable alternative is agreed, I will refund the amount paid for the product that cannot be supplied.

Risk of loss or damage passes to you when the product is delivered into your physical possession or collected by you.

21. Damaged, incorrect or faulty products

Please inspect physical products when you receive them and tell me as soon as reasonably possible if anything is damaged, incomplete or incorrect.

It helps if you provide a description and photographs of the issue. I may ask you to make the product available for inspection or return it using an agreed method.

Where a product does not meet your consumer rights, I will provide the remedy required by law. Depending on the circumstances, this may include repair, replacement, a price reduction or refund.

A request to report visible damage promptly helps me resolve matters with the manufacturer or courier, but it does not limit your statutory rights.

22. Changes requested after an order

Once you approve a digital package or physical-product specification, please assume that work may begin promptly.

If you request a change, I will tell you whether it is possible and whether it will cause additional cost or delay.

You will not be charged an arbitrary administration penalty. Any charge will reflect reasonable additional work, manufacturing costs or other direct losses caused by the requested change, and will be agreed before I proceed.

23. Chargebacks and payment disputes

If you do not recognise a transaction or believe that a payment has been taken incorrectly, please contact me promptly so I can investigate.

Nothing in these terms prevents you from exercising a lawful chargeback or another statutory remedy.

Where a chargeback is knowingly fraudulent or demonstrably improper, I reserve the right to seek recovery of the unpaid contractual amount and reasonable, evidenced losses through lawful means.

24. If I need to rearrange or cancel

Occasionally, illness, emergency, equipment failure, severe weather, loss of access to a location or another circumstance outside my reasonable control may prevent me from providing the service as planned.

I will contact you as soon as reasonably possible and will normally offer a rearranged date or another reasonable solution.

If I cannot provide the photography service and we cannot agree on a suitable alternative, I will refund payments for the part of the service not supplied.

If a manufacturer discontinues a product or cannot fulfil an order, I will offer a reasonable alternative or refund the affected product payment.

25. Technical failure and image loss

I use professional equipment and reasonable backup procedures, but no technical system is entirely free from risk.

If a technical failure, accidental corruption or another event means I cannot supply all or a substantial part of the expected photographs, I will discuss an appropriate remedy with you. Depending on the circumstances, this may include a reshoot, replacement service, proportionate price reduction or refund.

Nothing in this section excludes any remedy you are entitled to under consumer law.

26. Responsibility and liability

I will provide the photography service with reasonable care and skill and will supply goods and digital content that meet applicable consumer law.

I am not responsible for a loss that was not reasonably foreseeable when the contract was formed, or for a business loss arising from photographs purchased for private and domestic use.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory rights relating to services, goods or digital content.

27. Complaints

If you are unhappy with any part of the service or an order, please email lucy@lucyrosestudios.com and explain the issue.

I will acknowledge the complaint and make reasonable efforts to respond fully within 14 days. If I need longer to investigate, I will let you know.

I would always prefer the opportunity to resolve a concern directly and fairly.

 28. Privacy

Information about how I collect and use personal information is available in the Lucy Rose Studios Privacy and Cookie Policy:

https://lucyrosestudios.co.uk/privacy-policy

29. Changes to these terms

I may update these terms for future bookings.

The terms applying to your contract will be the version supplied or made available when your booking or order is accepted. A later change will not retrospectively alter an existing contract unless we both agree to it or the change is required by law.

30. Law and jurisdiction

These terms are governed by the law of England and Wales.

If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections and rights to bring proceedings available to you in the part of the UK where you live.

Nothing in this clause is intended to prevent either of us from using a court that has jurisdiction under applicable consumer law.
